1. About these Terms
These Terms & Conditions ("Terms") govern your use of danes.com.au (the "Site") and any purchase of goods or services from us. They form a legal agreement between you and DANES MANAGEMENT SERVICES PTY LTD(ABN: ), trading as Danes Coffee Roasters ("Danes", "we", "us", "our").

By placing an order or using the Site, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the Site or place an order.
2. Eligibility
To place an order or hold an account with us, you must:
- Be at least 18 years of age and able to enter into a legally binding contract;
- Provide accurate and current information; and
- Use the Site and our products lawfully and in accordance with these Terms.
If you are under 18, you may only use the Site under the supervision of a parent or guardian.
3. Orders and Acceptance
3.1 Placing an order
When you place an order through the Site, you make an offer to purchase the products at the price and on the terms displayed. You will receive an automated email acknowledging receipt of your order. This acknowledgement is not acceptance of your order.
3.2 Acceptance of orders
A binding contract is formed only when we send you a dispatch confirmation email indicating that your order has been shipped. Until that point, we may decline or cancel your order, in whole or in part, at our discretion — for example if:
- A product is out of stock;
- A pricing or product description error has occurred;
- Your payment is not authorised or is suspected to be fraudulent;
- We cannot deliver to your address; or
- We reasonably believe the order breaches these Terms.
If we cancel an order, we will refund any payment made for the cancelled portion.
3.3 Pricing errors
Despite our reasonable efforts, products on the Site may occasionally be incorrectly priced. If we discover a pricing error in an order before dispatch, we will contact you with the option to confirm at the correct price or cancel the order for a full refund.
3.4 Quantities
We may limit quantities of any product, refuse orders that appear to be for resale, and discontinue products at any time without notice.
4. Pricing, Payment and GST
4.1 Currency and tax
All prices are displayed in Australian dollars (AUD).
Under Australian tax law, certain food products (including roasted and ground coffee beans and most loose-leaf teas intended for human consumption) are GST-free. Other products — including brewing equipment, accessories, merchandise and ready-to-drink items — are GST-inclusive at the prevailing rate. Coffee beans, ground coffee and loose-leaf tea are GST-free. All other products are GST-inclusive.
A tax invoice will be included with your shipment.
4.2 Payment methods
We accept payment via Visa, Mastercard, PayPal, Apple Pay, Google Pay, Shop Pay and Afterpay (where displayed at checkout). Card payments are securely processed by Shopify Payments / Stripe. Payment data is encrypted in transit using TLS (Transport Layer Security). We do not store full card numbers, expiry dates or CVV codes on our servers.
4.3 Authorisation
You authorise us (or our payment processor) to charge your selected payment method for the total order amount, including taxes and shipping. If your payment is declined or reversed, we may cancel or hold your order until payment is received.
5. Shipping and Delivery
5.1 Where we ship
We ship to addresses within Australia. International orders are not accepted through the Site, but international enquiries are welcome; please email info@danes.com.au with your requirements for a customised quote. For international orders, all shipping costs, import duties and taxes are the responsibility of the customer.
5.2 Carriers
To provide the fastest delivery, we use both Australia Post and the Shippit delivery service (which uses various couriers depending on your location). We will select the most appropriate carrier for your order. If you have a preference, please contact us promptly after placing your order.
5.3 Delivery times
Standard delivery is estimated at 2–7 business days from dispatch, depending on your postcode. These are estimates only and not guaranteed delivery times. We are not liable for delays caused by carriers, weather, public holidays, or other events outside our control (see section 16).

5.5 Risk and title
Risk of loss or damage passes to you on delivery to the address you provide (or to a person at that address). Title in the goods passes to you when we have received payment in full.
5.6 Incorrect addresses and failed deliveries
It is your responsibility to provide a complete and accurate delivery address. If a parcel is returned to us as undeliverable due to an incorrect address, refused delivery, or failure to collect from a parcel locker or post office:
- We will contact you to arrange re-delivery; and
- You are responsible for the cost of re-shipping.
If you do not respond within 14 days, we may cancel the order and refund the product cost (less original shipping and any restocking fee).
5.7 Damaged or missing parcels
If your parcel arrives visibly damaged, please refuse delivery where possible and contact us immediately. If a tracked parcel is marked as delivered but not received, please contact us within 7 days so we can investigate with the carrier.
6. Coffee Subscriptions
6.1 How subscriptions work
When you sign up for a coffee subscription, you agree to receive recurring shipments at the frequency you select (e.g. weekly, fortnightly, monthly) at the price displayed at the time each shipment is processed.
6.2 Billing
Your nominated payment method will be charged automatically before each shipment. By subscribing, you authorise us to charge that payment method on a recurring basis until you cancel.
6.3 Price changes
We may change subscription prices from time to time. We will give you at least 14 days' notice by email before any price change takes effect, so you can pause, modify or cancel your subscription if you wish.
6.4 Skipping, pausing, modifying and cancelling
You may skip a delivery, pause your subscription, change your shipment frequency or product, or cancel at any time before the next billing date by:
- Logging into your account at danes.com.au and updating your subscription; or
- Emailing us at info@danes.com.au at least 24 hours before your next scheduled charge.
Cancellation takes effect from the next billing cycle. We will not charge cancellation or exit fees.
6.5 Failed payments
If a scheduled subscription payment fails, we will attempt to process the payment again over the following few days and notify you. If payment continues to fail, we may pause or cancel your subscription.
6.6 No minimum commitment
Unless explicitly stated at sign-up, there is no minimum number of shipments or commitment period.
7. Returns, Refunds and Consumer Guarantees
7.1 Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
A major failure occurs where:
- The product is unsafe;
- The product is significantly different from the sample or description;
- The product can't be used for its normal purpose and can't easily be made to do so within a reasonable time; or
- The product can't do what we said it would, or what you asked for, and can't easily be made to do so within a reasonable time.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be lawfully excluded.
7.2 Faulty, damaged or incorrect items
If your order arrives damaged, faulty, or is not what you ordered, please contact us at info@danes.com.au within a reasonable time. For perishable products (coffee, tea), please contact us within 14 days of delivery, providing:
- Your order number;
- A description of the issue; and
- Photos of the product and packaging where possible.
We will assess your claim and, where the law requires, offer a refund, replacement or repair as appropriate. For confirmed major failures, we will cover return shipping at our expense and refund original delivery costs.
7.3 Change of mind
We are not required by law to provide a refund or replacement if you simply change your mind. However, at our discretion, we may accept a change-of-mind return if all of the following apply:
- You contact us within 14 days of receiving your order;
- The item is unopened, unused, and in its original condition and packaging;
- The item is not a perishable product (coffee beans, ground coffee, tea and other consumables cannot be returned for change of mind for food safety reasons);
- The item is not a gift card, sale item, custom or wholesale order.
For change-of-mind returns:
- You are responsible for return shipping costs;
- Original delivery costs are not refundable; and
- A restocking fee of up to 10% may apply.
7.4 How to make a claim
To make any return or claim, email info@danes.com.au with your order number, reason for return and supporting photos. Do not return goods before receiving our written confirmation and a return authorisation. Goods returned without authorisation may not be accepted.
7.5 Refund processing
Approved refunds are processed to your original payment method within 5 business days of us receiving and inspecting the returned goods (or, where return is not required, within 5 business days of our written approval). Your bank or card provider may take additional time to display the credit.
8. Gift Cards
- Gift cards are valid for at least 3 years from the date of purchase, in accordance with the Australian Consumer Law (Gift Card Reform) requirements.
- No post-purchase fees apply during the validity period.
- Gift cards are redeemable on danes.com.au for the products available at time of redemption.
- Gift cards are not redeemable for cash, except where required by law.
- Lost or stolen gift cards cannot be replaced unless required by law.
- Gift cards are not refundable for change of mind.
- Where a gift card is used to pay for goods that are subsequently refunded under the Australian Consumer Law, the refund will generally be issued back to the gift card.
9. Promotions and Discount Codes
9.1 General
Discount codes, promotional offers and flash sale prices:
- Cannot be used on coffee subscriptions, wholesale accounts or 5×1kg bulk buys (unless the offer expressly states otherwise);
- Cannot be combined with any other offer, discount or promotion;
- Are not transferable and have no cash value;
- May be withdrawn or amended by us at any time without notice;
- Are subject to any specific terms stated at the time of the offer; and
- Are limited to one use per customer unless otherwise stated.
9.2 25% off first order
This offer is governed by the following additional terms:
- Eligibility: valid for new customers placing their first order only.
- Discount: 25% off the total value of your first purchase, excluding shipping costs, gift cards and subscriptions, unless expressly stated otherwise.
- Redemption: by entering the promo code at checkout, or via automatic application where offered.
- Limits: one use per customer; cannot be combined with any other discount, promotion or offer; not transferable; not redeemable for cash.
- Eligible products: the offer applies to coffee beans and bundles. Other products may be excluded at our discretion. Any exclusions will be noted on the offer page or at checkout.
- Duration: available for a limited time and may be withdrawn or amended at any time without notice.
- Acceptance: use of this offer constitutes acceptance of these promotional terms and our general Terms.
- Disclaimer: this promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Meta, Instagram, Google or any other platform. You are providing your information to danes.com.au and not to those platforms.
10. Wholesale Accounts
Wholesale customers operate under a separate wholesale agreement, which sets out pricing, minimum order quantities, payment terms, returns and other commercial terms. The general consumer-facing terms in this document (including change-of-mind returns and the 25% off promotion) do not apply to wholesale orders. 11. Customer Accounts
11.1 Your account
You may register for an account to make checkout faster and manage subscriptions. You are responsible for:
- Keeping your account credentials confidential;
- All activity that occurs under your account; and
- Notifying us promptly at info@danes.com.au if you suspect unauthorised use.
11.2 Suspension
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or misused the Site.
12. User Content
12.1 Reviews and submissions
If you submit reviews, photos, comments or other content ("User Content") through the Site or our social media channels, you:
- Confirm that the content is your own and does not infringe any third party's rights;
- Grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, publish and display the content in connection with our business; and
- Acknowledge that we may moderate, edit or remove content that we consider inappropriate, unlawful or otherwise unsuitable.
12.2 Prohibited content
You must not submit content that is unlawful, defamatory, obscene, harassing, misleading, infringing, or that contains personal information about others without their consent.
13. Intellectual Property
All content on the Site — including the Danes name and logo, product images, photography, graphics, text, recipes, blog content and software — is owned by us or our licensors and is protected by Australian and international intellectual property laws.
You may view, print and download content from the Site for personal, non-commercial use only. You must not reproduce, distribute, modify, sell or commercially exploit any content without our prior written permission.
14. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in breach of any applicable law;
- Interfere with the Site's operation, security or features;
- Attempt to gain unauthorised access to any part of the Site or our systems;
- Use any automated means (bots, scrapers, crawlers) to access the Site without our written permission;
- Resell our products without our written authorisation; or
- Submit false, misleading or fraudulent information.
We may suspend or terminate your access to the Site if you breach this section.
15. Disclaimer and Limitation of Liability
15.1 Site provided "as is"
Subject to section 7.1 and any other rights you have under the Australian Consumer Law, the Site and its content are provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, secure or free from viruses.
15.2 Limitation of liability
To the maximum extent permitted by law, and except for liability that cannot lawfully be excluded under the Australian Consumer Law:
- Our total liability to you in connection with any product or your use of the Site is limited, at our option, to the resupply of the product, the repair of the product, or a refund of the price you paid;
- We are not liable for any indirect, incidental, special, consequential or economic loss (including loss of profits, business interruption or loss of data); and
- Nothing in these Terms operates to limit any liability that cannot lawfully be excluded.
15.3 Allergens and dietary information
While we take care with product descriptions, we cannot guarantee that our products are free from cross-contamination with allergens. If you have a serious allergy or dietary requirement, please contact us before ordering.
16. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay is caused by events beyond our reasonable control, including: natural disasters, fire, flood, severe weather, pandemic or epidemic, war, civil unrest, terrorism, government action or restriction, industrial action, courier or supplier failure, power or communications failure, or cyberattack.
If a force majeure event continues for more than 30 days, either party may cancel any unfulfilled order and we will refund any payment for goods not yet dispatched.
17. Privacy
Your privacy is important to us. Our collection, use and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.
18. Dispute Resolution
If you have a complaint or dispute with us, please contact us first at info@danes.com.au so we can try to resolve it informally. We will acknowledge your complaint within 5 business days and aim to provide a substantive response within 30 days.
If we cannot resolve a dispute directly, you may also be able to seek assistance from:
- NSW Fair Trading — fairtrading.nsw.gov.au, 13 32 20; or
- The relevant tribunal or court in New South Wales.
Nothing in this section limits your right to pursue any other legal remedy available to you.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
20. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. The version of the Terms in effect at the time you place an order will apply to that order. Where changes are material and affect existing subscriptions or accounts, we will give reasonable advance notice (for example, by email or a prominent notice on the Site).
21. General
- Severability: If any part of these Terms is found to be unenforceable, the rest will continue to apply.
- Entire agreement: These Terms, together with our Privacy Policy and any wholesale or subscription-specific terms, form the entire agreement between you and us regarding the Site and our products.
- No waiver: A failure or delay by us to enforce any right under these Terms is not a waiver of that right.
- Assignment: You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a sale or restructure of our business.
- Headings: are for convenience only and do not affect interpretation.
